General Terms and Conditions

1.  Scope of Validity

The following Terms and Conditions shall apply to all business connections between

and the customer purchasing goods in our webshop. When placing an order the customer acknowledges these Terms and Conditions as mandatory for both sides. Any changes must be in writing.

2.  Conclusion of Contract

The goods displayed in the online store www.bestmassage.co.uk do not constitute a legally binding offer; instead it is merely a non-binding invitation to treat. By clicking ‘Buy’, the customer makes a legally binding commitment to purchase the goods in the shopping basket. The customer shall receive an order confirmation immediately after the order has been placed. The sales contract shall only enter into effect upon receipt of our separate order confirmation via E-Mail within an appropriate period of time.

3.  Offers, Prices

All information, also concerning prices, in the webshop, in advertisements, newsletters etc. are subject to change. Changes in prices due to increases in the market prices of our suppliers as well as deviations in the technical design shall remain reserved. All prices include VAT and are valid ex warehouse. Additional shipping costs arise according to our terms of shipment.

Images and descriptions of the delivered goods in advertisements, price listings, etc. shall not be binding for the accomplishment of the contract. The same holds true for the variation in material, colour and covering. Tolerances in material and other inevitable tolerances are possible. Weights and measures are considered to be approximately.

4.  Terms of Payment/Reservation of title

We exclusively accept the following methods of payment:

Prepayment

We accept direct transfers to our German bank account. Go through the normal purchase procedure, filling in your delivery details at the checkout page, then choose the 'Bank Wire Transfer' payment option and 'Buy“. The amount invoiced shall be paid in full to the account given in the Purchase Confirmation sent via E-Mail (a bank wire transfer).

PayPal

The payment can be processed through the customer’s PayPal account. For this purpose the customer will be redirected to the PayPal payment page.

Credit/Debit Cards

The amount invoiced shall be charged in full and contemporary to the customer’s credit or debit card.

The customer shall pay the amount invoiced within 14 days after bill receipt. Upon expiry of the payment deadline, the customer shall get in default automatically. Unless fully paid, the goods shall remain our property.

5.  Terms of Delivery

The shipping shall be ensued within 3 to 4 working days when cashed or within 7 - 8 working days in case of delivery by a trucking company. Delivery dates are considered to be agreed. Part shipment shall remain reserved if not all ordered goods are in stock. The customer shall be informed immediately about delivery delays. For the adherence to the delivery date, the seasonable shipping is sufficient. The customer shall grant a reasonable extension and only after its expiry is the customer entitled to cancel thecontract. Damage claims in addition to this are precluded. If an order cannot be delivered due to unforeseen shortages of our suppliers, the right to rescind the contract on our part and refund the paid amount of money shall be reserved.

6.  Terms of Guarantee

The following durations of guarantee shall apply:

  • 10 years on frame and legs
  •  2 years on covers
  •  6 months on free accessories

As for the rest the official warranty period shall apply.

Defects or any other damage caused by negligent or improper treatment of the goods, improper installation, the use of unsuitable accessories or changes made to the original parts by the customer shall not be covered by the warranty.

In the case of a justified and timely notification of defects the customer shall be entitled to improvement of the goods. We shall be entitled to propose a replacement of the item or a price reduction if such improvement is not possible. In case of replacement the customer shall allow us reasonable time of 4 weeks. Ulterior claims by the customer shall be excluded. We shall not be liable for damages accrued not on the article of sale itself and particularly not for loss of profit or other financial losses of the customer as well as for claim for damages.

7.  Cancellation Policy

Right of withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

8.  Data Privacy

All the data concerning the purchase provided by the customer will be filed. We shall treat them as confidential and we shall not use them for promotional purposes unless the customer agreed expressly by e.g. subscribing to our newsletter. The personal data of the customer shall not be transferred for use to third parties. For more information please read our privacy policy.

9.  Other

Place of performance and place of jurisdiction is Rastatt, Germany. Should individual terms of this Agreement be ineffective or lose their effectiveness due to later circumstances or should a loophole emerge in this Agreement, the legal effectiveness of the other provisions is not affected.
